The family of Jahxy Peets is reportedly suing a Florida hospital after alleging its staff fatally broke the newborn’s neck and “didn’t tell anybody.”

Here’s What The Hospital Staff Is Accused Of Doing To Jahxy “Jazzy” Peets, The Newborn Baby

According to Fox 35 Orlando, Peets’ family reportedly filed a lawsuit against the Newborn Intensive Care Unit at Winnie Palmer Hospital for Women and Babies on Friday, October 18.

The suit reportedly asserts that Peets was born prematurely at 22 weeks in June 2022. Two weeks later, an MRI reportedly revealed that the 1-pound infant’s neck had been broken.

“… this type of spinal cord injury could not occur without the use of excessive force when handling a newborn,” the family’s suit reportedly asserts.

Peets’ spinal cord injury reportedly left her paralyzed and unable to breathe without support. Then, on November 25, 2022, the infant passed away.

The family’s attorney, Nicole Kruegel, addressed the public in a press conference on Monday, October 21.

“Somebody in the NICU broke her neck, and they didn’t tell anybody,” Kruegel reportedly stated. “…The type of injury that Jazzy suffered is a mandatory reportable injury to the Department of Children and Families, to the police; every single healthcare provider has a duty to report this.”

More Details On The Family’s Lawsuit & The Response Of The Florida Hospital

According to the outlet, the hospital later admitted liability for the infant’s death. Additionally, Winnie Palmer Hospital reportedly shared a statement on the matter with Fox 35 Orlando.

“We will not address specific medical cases publicly but will share that the delivery of care to extremely premature babies is complex and emotional work for parents, doctors, and nurses. We offer our deepest sympathies to this family, and to any family who suffers the loss of a child, but also believe those who provide care in this environment should be judged on facts, not speculation,” the hospital reportedly asserted. “We look forward to discussing the facts of this case in the appropriate forum.”

At this time, it remains unclear whether the healthcare provider allegedly responsible for the infant’s injury remains employed with the company. Meanwhile, the infant’s mother, Gianna Lopera, has shared her family’s grief.

“I never got a chance to hear my daughter cry. She never had a chance to meet her siblings or her family. We never celebrated a single milestone, we only held her four times,” Lopera reportedly shared. “Now we’re scared to even get pregnant because — now [we] don’t know if [our] next baby is going to make it. [We] don’t know if the next hospital is going to make the same mistake with my second baby.”

According to the outlet, the infant’s family is seeking at least $50,000 and a jury trial for the case.

A Couple In Georgia Faced A Similar Tragedy Last Year

Two Georgia parents faced a similar tragedy in 2023. As The Shade Room previously reported, Jessica Ross gave birth to her and Treveon Isaiah Taylor Sr.’s son at the Southern Regional Medical Center in July of that year. During the natural labor, the infant’s shoulders reportedly became “stuck.”

Subsequently, Ross underwent a delayed C-section. Amid this, a doctor reportedly applied excessive force on the infant’s head. Ultimately, that portion of the child’s body was reportedly delivered vaginally, while the rest was delivered via C-section.

Afterward, the hospital allegedly wrapped the infant in a blanket and “propped” his head on top of his body before allowing the mother to hold the child. Ultimately, a funeral home informed the family of their son’s fatal injury and decapitation.

In the months that followed, a lawsuit was filed against the Georgia hospital amid backlash for a pathologist who reportedly posted the child’s autopsy online.
